JUSTICE JYOTI SARAN ORAL ORDER 20-02-2015 Heard Mr. Mukesh Kumar Singh, learned counsel appearing on behalf of the petitioner and learned counsel for the State.
The petitioner apprehends his arrest in connection with Kateya P.S. Case No.49 of 2013 registered for the offences punishable under section 414 of the Indian Penal Code and the provisions of the Animal Cruelty Act.
Mr. Singh, learned counsel appearing for the petitioner with reference to the allegations made in the FIR submits that whereas the petitioner has been allegedly held to be the owner of the cattle and thus section 414 of the Indian Penal Code would not apply and the provisions of the Animal Cruelty Act are bailable.
Having heard learned counsel for the parties and
Patna High Court Cr.Misc. No.36962 of 2014 (2) dt.20-02-2015 taking note of the submissions advanced, let the petitioner, namely, Mintu Mian in the even of his arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Kateya P.S. Case No.49 of 2013 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Jyoti Saran, J) SKPathak/- U T
