JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-07-2015 Heard learned counsel for petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Bairganiya P.S. Case No. 42 of 2015 registered under Sections-341, 342, 326, 307, 498A/34 of the Indian Penal Code and subsequently, Section-302 of the Indian Penal Code was also added.

Taking note of fardbeyan which amounts to dying declaration of the informant, I am not inclined to extend the privilege of anticipatory bail to the petitioners and accordingly, their prayer for anticipatory bail in connection with Bairganiya P.S. Case No. 42 of 2015 pending in the court of Learned Chief Judicial Magistrate, Sitamarhi stands rejected.
