JUSTICE SATYAVRAT VERMA ORAL ORDER 15-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) and 30(c) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 27.02.2022, prosecution report has been submitted in the case and has antecedent of one case. Allegation is of recovery of 20 litres of liquor and 1000 kg of jawa mahua which was destroyed on the spot. Learned counsel for the petitioner submits that though in the F.I.R. it is alleged that the recovery was made from his hut but in the hut it is just not possible to keep such huge

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody and prosecution report has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with G.O. Case No. 184 of 2022.
