JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-07-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Sultanganj PS case no. 7 of 2018 instituted for the offences punishable under Sections 302, 324/34 of Indian Penal Code. The allegation is that the son of the informant was called by his friends in the morning but he did not return, next day his dead body was found near a temple and it is alleged that his friends including the petitioner have killed him. The learned counsel for the petitioner submits that merely suspicion has been raised against the petitioner and the only evidence is that in the day hours the deceased was seen along with the petitioner, except which there is no other material against him and he

Patna High Court Cr.Misc. No.33752 of 2018 (3) dt.23-07-2018 2/2 has no criminal antecedent. It is further submitted that similarly situated co-accused person has already been granted bail by a co-ordinate Bench of this Court vide order dated 19.06.2018 passed in Cr.Misc. no. 35150 of 2018.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. Bhagalpur in connection with Sultanganj PS case no. 7 of 2018.
