The petitioner seeks bail in connection with Chhatauni P.S. Case no. 179 of 2017 registered for the offence punishable under Sections 304-B, 201/34 of the Indian Penal Code.

The petitioner along with other accused persons are said to have committed murder of the sister of informant over dowry demand.

It is submitted by the learned counsel for the petitioner that the petitioner happens to be brother-in-law of the deceased. He has been living separately from the informant and her husband and has no concern with the affair of the deceased

Patna High Court Cr.Misc. No.53751 of 2017 (2) dt.09-11-2017 2/2 and her husband. The allegation levelled against the petitioner is not specific rather omnibus. No occurrence as alleged ever took place. As a matter of fact, the deceased has died due to natural death. The petitioner has been languishing in custody since 21.07.2017.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, District-East Champaran in connection with Chhatauni P.S. Case no. 179 of 2017.
