Mr. Sri Ahtash Ali Khan ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-07-2018 Heard learned counsel for the petitioners and the counsel appearing on behalf of the State.

Petitioners are in custody in connection with Parbatta P.S. case No. 194 of 2016 for the offence under sections 364(A), 365, 323 and 379 of the Indian Penal Code. Learned counsel for the petitioners submits that petitioner no.1 has clean antecedent whereas petitioner no.2 has earlier made accused in Parbatta P.S. Case No. 18 of 1999 under sections 147, 447, 323 and 504 of the Indian Penal Code. Referring to the allegation levelled in the instant case and the statement under section 164 of the Cr.P.C. learned counsel submits that the statement was recorded after 5-6 months.

The petitioners are in custody since 23.04.2018. Considering the aforesaid, let the petitioners, named above, be enlarged on bail after 23.08.2018 on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Khagaria, in connection with Parbatta P.S. Case No. 194 of 2016.
