The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

The complainant alleged that he agreed to purchase 7 Katthas of land at the rate of Rs. 85,000/- per Kattha. The petitioner handed over Rs. 4,50,000/- and later on total amount of Rs. 6,35,000/- including Rs. 4,50,000/- was given to the petitioner, but the petitioner only executed the deed with regard to 4 Katthas of land.

It is submitted that according to the deed of agreement to sale, the petitioner was to execute the deed with regard to only 4

Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri A.A. Sahay, the learned Judicial Magistrate 1st Class, Nalanda at Biharsharif in Complaint Case No. 136C of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
