JUSTICE MADHURESH PRASAD ORAL ORDER 02-02-2018 Heard counsel for the petitioner and the State. Petitioner is an accused in a case registered for offence under sections 147, 148, 149 and 302 IPC, 27 Arms Act, sections 38, 39 and 40 of the UAP Act and 17 of the CLA Act. Counsel for the petitioner submits that as per allegation 22/25 miscreants took away father of the informant and thereafter he has been done to death. There is no specific allegation against the petitioner and till date he has not been put on TI parade and the court below has not considered his prayer for bail only because he has antecedent.
Prior to the lodging of this case, he is accused in other cases mentioned in paragraph 3 of the bail application. In some of the cases he is already on bail. Petitioner is in custody in the instant case since 13.4.2017. Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II, Banka in Sessions Trial No.
Patna High Court Cr.Misc. No.60698 of 2017 (3) dt.02-02-2018 (i) One of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
(ii) The petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
