The petitioner seeks regular bail in connection with Sitamarhi PS case no. 601 of 2017 instituted for the offences punishable under Sections 302, 201/34 of Indian Penal Code. The allegation is regarding the accused persons having killed the husband of the informant.

The learned counsel for the petitioner submits that the name of the petitioner has transpired only upon the statement made by the witnesses to the effect that the petitioner had gone to the house of the informant and threatened the deceased prior to the dead body of the deceased having been recovered, but this fact has not been disclosed by the informant in her written statement made before the police, hence the petitioner has been falsely implicated

Patna High Court Cr.Misc. No.33863 of 2018 (3) dt.23-07-2018 2/2 in the present case. It is further submitted that the petitioner is having a clean antecedent and he is in custody since 23.02.2018. Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi PS case no. 601 of 2017.
