JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2017 Heard the learned counsel for the petitioner and the Mr. Ram Anurag Singh, learned A.P.P. for the State. The petitioner seeks regular bail in connection with Kanti P.S. Case No.361 of 2017 instituted for the offences under Section 30(a)/38/41 of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 80.8 litres of English liquor from the house of Ganesh Chaudhary. The learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner, the main accused Ganesh Chaudhary has already been granted anticipatory bail by this Court, the petitioner is in custody since 05.10.2017 and the petitioner has got a clean antecedent barring one case on same and similar allegation.

No.60777 of 2017 (2) dt.21-12-2017 2/2 Considering the nature of accusation and the period of custody already undergone, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Kanti P.S.
