The petitioner nos. 1, 2 and 4 apprehend their arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, petitioners are alleged to have snatched cash of Rs. 60,000/- from the pocket of complainant.

It is submitted that present case has been filed by the complainant side only with a view to save their skin from the

Patna High Court CR. MISC. No.21393 of 2023(3) dt.11-07-2023 2/2 case bearing SC/ST Case No. 41 of 2021 dated 27.09.2021 which was filed by the petitioner no. 1 against the informant and others. As a matter of fact, complainant was pressuring the petitioners to compromise the case and when petitioners refused to do so, this false and fabricated case has been lodged against the petitioners. Petitioners claim clean antecedents. Considering the facts aforesaid, the petitioner nos. 1, 2 and 4 above-named, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Complaint Case No. 739 of 2022 corresponding to Sessions Trial No. 277 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
