JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-04-2015 Heard learned counsel for the petitioners as well as learned counsel for the State.

In this application for anticipatory bail the petitioners apprehend their arrest for the offences punishable under sections 419, 420, 467, 468, 471, 472, 473 and 120(B)/34 of the I.P.C and section 66 (C) and 66 (D) of the Economic Offences Act. On receiving information that the petitioner Siyaram Singh and other co-accused in collusion and conspiracy with others and also in connivance with scholars and owner of Navrang Studio, Bihta are indulged to get ITI trained young people

Patna High Court Cr.Misc. No.37050 of 2014 (3) dt.09-04-2015 2/3 appeared in different examinations conducted by the Railway Recruitment Board a raid was conducted. The petitioners are alleged to be the members of the gang and the petitioners were managing the candidates for the purposes from whom huge consideration money was used to be taken. It has been revealed that at the instruction of the petitioners Siyaram Singh, Doctor @ Madhukar Kumar and Raju @ Rajiv Ranjan photos of scholars were mixed and they are doing these works off and on. Submission is of false implication and further that in this case co-accused Anuj Kumar @ Jhandu and Tanuj Kumar @ Mantu have been allowed regular bail by this Court. The petitioners have got no criminal antecedents and they have been implicated only on the basis of statement of a co-accused and as such these petitioners deserve sympathetic consideration, to which the learned A.P.P. opposes.

Considering the allegation attributed against the petitioners this Court is not inclined to grant privilege of pre-arrest bail to the petitioners and accordingly their such prayer stands rejected in connection with A.C.J.M. Danapur in Economic Offence Case No. 07 of 2014.

However, in case and if so advised the petitioners surrender and seek regular bail then their prayer for regular bail

Patna High Court Cr.Misc. No.37050 of 2014 (3) dt.09-04-2015 3/3 shall be considered on its own merits without being prejudiced by the order of this Court.
