Learned counsel for the respondent is present. It has been pointed out by the learned counsel for the petitioner that by the impugned order, the interim maintenance of Rs.3500/- has been allowed under Section 24 of the Hindu Marriage Act in favour of the respondent. It has been also pointed that the aforesaid direction has not been complied by the petitioner-husband by making payment of the aforesaid amount.
It appears from the order dated 03.03.2017 that the adjournment has been sought on behalf of the petitioner for seeking instruction regarding the compliance of the order dated 03.02.2016 passed in the matrimonial case. Nothing has been brought on record to show that the said order has been complied and payment up-to-date has been made. Considering the totality of the matter, this Court does not find that it is a fit case to invoke the jurisdiction under Article 227 of the
Patna High Court C.Misc. No.495 of 2016 dt.03-07-2017 Constitution of India for interdicting the impugned order. The application is, accordingly, dismissed.
