JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-12-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sahiyara P.S. Case No. 137 of 2017 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Liquor Prohibition and Excise Act, 2016. The allegation is regarding recovery of 6 litres of illicit liquor from the joint possession of all the accused persons. The learned counsel for the petitioner submits that no recovery as alleged has been effected from the conscious possession of the petitioner. The petitioner is accused in two other cases, on same and similar allegations, however he has already been granted bail in the said two cases. The petitioner is said to

Considering the nature of accusation and the period of custody already undergone, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II-cumSpecial Judge, Excise Act, Sitamarhi in connection with Sahiyara P.S. Case No. 137 of 2017.
