2. In this case, the petitioner is seeking regular bail in connection with Sone Nagar Rail P.S. Case No. 4 of 2006 registered for the offences punishable under Sections 431, 440 of the Indian Penal Code and Section 147, 150 of Railway Act.
3. At the very outset, learned senior counsel Mr. Krishna Prasad Singh has submitted that it is a case of misuse of privilege of bail.
4. Learned counsel for the petitioner has submitted that it is true that trial hampered for pretty long time due to nonappearance of the petitioner, but being for eight months in custody he has amply been punished for his default. It has also been submitted that earlier he was on bail.

Considering the above-mentioned facts and circumstances and also considering that the petitioner remained under custody for 8 months, let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Court of 6th Additional Sessions Judge III, Aurangabad in connection with Sone Nagar Rail P.S. Case No. 4 of 2006, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. (ii) In case of failure in appearance on two consecutive dates in the Court, the learned court below will be at liberty to cancel the bail bonds of the petitioner.
