JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-07-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Nawada Town P.S. Case No. 343 of 2015 registered under Sections-269, 270, 418, 420 & 120(B) of the Indian Penal Code, Section-5 of Medical Termination of Pregnancy Act, 1971 and Sections-15(2)(D) of All India Medical Council Act, 1956.

Petitioner happens to the proprietor of Maa Gulabiya Nursing Home, Nawada and at the time of raid, some patients were found admitted in the above-said nursing home of the petitioner.

No.29006 of 2015 (2) dt.27-07-2015 2/2 The contention on behalf of the petitioner is that the nursing home of the petitioner is well recognized by the State Government which is evident from perusal of Annexure-2 to this petition and moreover, not a single patient came forward to make any complaint against the petitioner or his nursing home.

Accordingly, it is ordered that the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, shall be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Nawada Town P.S. Case No. 343 of 2015 to the satisfaction of Chief Judicial Magistrate, Nawada subject to conditions as laid down u/S 438(2) of the Cr. P.C.
