JUSTICE RAKESH KUMAR ORAL ORDER 20-11-2017 Heard Sri Tribhuwan Narayan, learned counsel for the petitioner and Sri Nirmal Kumar Sinha, learned A.P.P. The sole petitioner, who is in custody since 19.8.2017 in connection with Excise Case No. 1330 of 2017 [ arising out of Kudra P.S. Case No. 163 of 2017] , registered for the offence under Section 30(a), 38(1)(2) of the Bihar Prohibition And Excise Act , 2016 ( hereinafter referred to as the "Excise Act") , has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that on false accusation of recovery of about 7 Liter 200 ML of Indian Make foreign liquor from the rented house of the petitioner, petitioner has been made accused. Learned counsel for the petitioner submits that petitioner was earlier made

Patna High Court Cr.Misc. No.55471 of 2017(2) dt.20-11-2017 2/2 accused in a case relating to offence under the Excise Act and as such, he has again falsely been implicated in the present case.

Be that as it may, considering the nature of accusation and period of custody, let the petitioner Banti Ram be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Spl. Judge - cum - A.D.J. 4th, Kaimur at Bhabua / concerned court in connection with Excise Case No. 1330 of 2017 [ arising out of Kudra P.S. Case No. 163 of 2017 ] .
