====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 15-06-2026 Heard the petitioner, Mr. Sudhir Kumar (In Person) and learned counsel for Magadh University and learned counsel for the respondents-State.

2. The petitioner in the present writ application has prayed for appropriate direction to be given to the respondent no.1 to 3 to make payment of salary dues from 08.12.1981 up to January 10, 2016.

3. Learned counsel appearing for respondents-State and Magadh University object to the maintainability of the writ application on the ground of delay and laches. As per them no

Patna High Court CWJC No.5148 of 2025(4) dt.15-06-2026 2/2 cogent explanation has been given in the writ application for delayed filing.

Responding to the aforesaid objection, the petitioner Mr. Sudhir Kumar (In Person) submits that for seeking the same relief the petitioner had earlier also filed a writ application bearing CWJC No.2483 of 2017 which was withdrawn by him on 18.05.2018 (Annexure-P/15) without seeking any liberty from the court to re-agitate the matter.

Having heard the parties on the issue of the maintainability of the present writ application, I find that in the writ application no cogent explanation for inordinate delay has been given by the petitioner and also given the fact that earlier for the same relief the petitioner had approached this Court in the year 2017 vide CWJC No.2483 of 2017 which was withdrawn by the petitioner without seeking any liberty to reagitate the issue in future, taking all these aspects into account, I am of the view that the writ application is not fit to be entertained on the ground of delay and laches and is accordingly dismissed.
