The petitioner seeks bail in a case registered under Sections 363, 365 of the Indian Penal Code.

According to FIR, it is alleged that the informant delivered a child in DMCH, Darbhanga and when she woke up in the morning, she found that her infant child was traceless. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 17-12-2018. Charge sheet has already been submitted. The child has already been recovered. The petitioner has been made accused due to mistake of fact. The mother of the petitioner was also admitted in the same hospital. The petitioner is a lady.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S. Case No. 604 of 2018.
