JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2017 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners seeks regular bail in connection with Excise Case No.434 of 2017 instituted for the offences under Section 30(d) of the Bihar Prohibition and Excise Act, 2016 and Sections 2(e), 3, 5 and 13 of Bihar Mahua Flower Act. The allegation is regarding recovery of 2000 kg. illegal Mahua flower from a Tata Pick Up Van. The learned counsel for the petitioners submits that the petitioners have no concern with the said Pick Up Van inasmuch as they are neither the owner of the Pick Up Van nor they were the occupants of the said Pick Up Van at the time when
Patna High Court Cr.Misc. No.61033 of 2017 (2) dt.21-12-2017 2/2 the seizure was made. The petitioners have got a clean antecedent and are in custody since 15.10.2017.
Considering the nature of accusation, the period of custody already undergone and the fact that they have got a clean antecedent, I direct the petitioners named above to be released on regular bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Gaya in connection with Excise Case No.434 of 2017.
