JUSTICE ARUN KUMAR ORAL ORDER 26-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 18.11.2017, seeks bail in Shahpur PS Case No. 218 of 2017 registered under Sections 302, 201 and 120B/34 of the IPC.

The allegation in brief is that the informant's son is suspected to be killed by Chandu Rai, Manoj Rai, FIR named accused persons, along with their associates in coming in conspiracy with them.

Learned Counsel for the petitioner submits that the petitioner is not named in the FIR and no material transpired against him during investigation except that he conspired to get the informant's son eliminated, but there is no motive for committing such occurrence, the FIR named accused Chandu Rai and another coaccused Govind Kumar, similarly situated, have been admitted to bail by a coordinate Bench of this Court as well as by this Court, the investigation of the case is already complete and the petitioner bears no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Subhash Kumar is directed to be released on bail
