2. The petitioner apprehends his arrest in connection with Bausi P.S. Case No. 62/2024 registered for the offence punishable under Sections 147/149/341/324/325/307/354(B) / 379/504 of the Indian Penal Code. Later on, Section 302 of the Indian Penal Code was added.
3. The prosecution story is short is that the informant namely Mahboob Alam alleged that on 06.04.2024, the goat of Md. Arshad (petitioner) was gazing his field and on protest, all the named accused persons including this petitioner started assaulting them with deadly weapons. It is further alleged that this petitioner hit Md. Sadik by sickle on his head who died during the course of treatment.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.19745 of 2025(4) dt.10-07-2025 2/2 petitioner has been falsely implicated in this case. He further submits that there is general and omnibus allegation of assault against 17 named and 10 unknown persons. No specific allegation of assault is attributed against this petitioner.
5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.
6. Considering the accusation against the petitioner and as per the postmortem report, death caused due to injuries by assault, this application is dismissed.
