The petitioner seeks regular bail in connection with Ara Muffasil (Dhobha O.P.) P.S. Case No. 10 of 2018 for the offences punishable under Sections 304 (B)/34 of the Indian Penal Code.
The allegation against the petitioner and other coaccused persons is sprinkling kerosene oil on the wife of the petitioner and setting her body on fire resulting in her death. The learned counsel for the petitioner, referring to various paragraphs of the case diary, has submitted that the present case is a case of suicide which has also been accepted by the police inasmuch as the charge sheet has not been filed under section 302 and 304(B) I.P.C.

No.34033 of 2018 (3) dt.23-07-2018 2/2 It is further submitted that the independent witnesses have also corroborated the fact that the deceased was a stubborn lady and she had poured kerosene oil on her body and set herself on fire. It is also submitted that the police had broken the door of the room from outside in which the dead body of the deceased was found. The petitioner is stated to be having a clean antecedent and is languishing in custody since 25.01.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Muffasil (Dhobha O.P.) P.S. Case No. 10 of 2018.
