JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-12-2022 The present writ petition has been filed seeking the following reliefs:- "1(i). To issue an appropriate order/s, direction/s including a writ preferably in the nature of mandamus commanding and directing upon the respondents to make the payment of arrears of family pension to the petitioner whose father was getting freedom fighter pension died on 9-52017 and subsequent there to the widow, mother of the petitioner also died on 23-3-2021.

(ii) To Direct the respondents to make the payment of arrears of family

Patna High Court CWJC No.5098 of 2022(2) dt.20-12-2022 2/2 pension from the period 9-5-17 admissible to the mother of the petitioner till her life time also taking into the consideration that the petitioner's father has given his name in the column of nominee.

(iii) To Direct the respondents to make the payment of family pension for the above mentioned period along with penal interest on account of delay and latches on the part of the respondents.

(iv) To any other relief/s to which the petitioner is entitled in the facts and circumstances of the case.

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are available under the law. Liberty, so sought, is granted.

The writ petition stands dismissed as not pressed.
