2. The petitioner apprehends his arrest in connection with Town P.S. Case No. 770 of 2023 for the offence registered under sections 8/17(c), 18(c)/19(c) of the N.D.P.S. Act lodged on 23.09.2023 by the informant, Vijay Kumar Singh.
3. As per the prosecution story, the informant has alleged that upon information that the two brothers, Naveen Chandra Lal and Deepraj Barnwal @ Tinku who are having general store shop business and a warehouse adjacent to the house, the Pankaj Market are selling 'doda' (poppy) on a wide scale. The same was raided and there is recovery/seizure of 754 kg 'doda'. Accordingly, the FIR.

4. Learned Counsel for the petitioner tried to impress upon this Court that the actual seizure/recovery is from the business centre of his brother, Deepraj Barnwal.
5. Learned APP pointed out that a bare perusal of the FIR would show that the name of this petitioner as also his brother has come and further when the raid was conducted, his son Himesh Raj was present. The recovery/seizure is 754 kg which is much beyond the prescribed quantity of 50 kg.
6. In the aforesaid background, it would be appropriate that the petitioner seeks bail.
