Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 471, 504 of the Indian Penal Code. The prosecution case is that petitioner Suresh Ram asked the informant to vacate the land. Subsequently the informant came to know that his land has been transferred at the behest of petitioner Suresh Ram in favour of Ram Sakha Devi. When the informant went the petitioner Suresh Ram to protest then he accepted the transfer and abused the informant and took away bag containing rupees twenty five thousands and clothes.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.28934 of 2015 (2) dt.27-07-2015 2/2 petitioners that sale deed was executed on 01.07.1988 when the present case was registered on 12.05.2015 and on the purchased land Ram Sakha Devi has constructed the house and the mutation has been done in her favour. Considering the nature of accusation and the delayed lodging of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Laheriasari P.S. Case No. 213 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
