JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-09-2021 The instant case has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

The present writ petition has been filed for quashing the order dated 13.02.2021, passed by the Sub Divisional Officer-cum-Licensing Authority, Danapur, Patna whereby and whereunder the license of the petitioner bearing License no. 60 of 2007 has been cancelled.

At the outset, the learned counsel for the petitioner

Patna High Court CWJC No.8289 of 2021(2) dt.13-09-2021 2/2 seeks liberty to prefer an appeal under Rule 32 (iii) of the Bihar Targeted Public Distribution System (Control) Order, 2016, however seeks a direction upon the appellate authority to dispose of the said appeal, expeditiously.

The learned counsel for the respondent- State Sri Upendra Pratap Singh (AC to SC 4) has got no objection. Accordingly, the present writ petition stands disposed of with liberty to the petitioner to file appropriate appeal against the aforesaid order dated 13.02.2021, passed by the Sub Divisional Officer-cum-Licensing Authority, Danapur (Patna) and in case, such an appeal is filed within a period of four weeks from today, the same shall be considered on merits and disposed of in accordance with law, by the appellate authority, by a reasoned and a speaking order within a period of eight weeks, thereafter.
