The petitioner has filed the present application under Sections 439 and 440 of the Code of Criminal Procedure for grant of bail in connection with Special Case No.11632 of 2019 arising out of Agamkuan P.S. Case No.1078 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

It is submitted by the learned counsel for the petitioner that co-accused Rajeev Kumar having identical allegation has already been granted bail by a Bench of this Court vide order dated 05.03.2020 passed in Cr. Misc. No.12743 of 2020.

No.15721 of 2020(2) dt.13-05-2020 2/2 Regard being had to the nature of allegation, the submission made above and the period undergone by the petitioner in custody, he is directed to be released on bail on furnishing bail bond of Rs.5000/- (five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 11632 of 2019 arising out of Agamkuan P.S. Case No.1078 of 2019.
