The petitioner seeks bail in a case registered for offences under Sections 30 (A) and 38(A) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 24.9 litres of Nepali Soufi Wine and 27.9 litres of "Mahua Liquor" were recovered from the pond and petitioner has been implicated on the basis of confessional statement of coaccused Ajay Kumar and Munna Ram who have been caught by the police on chase while they were trying to flee
Patna High Court Cr.Misc. No.53784 of 2017(2) dt.09-11-2017 2/2 away seeing the raiding police party. Petitioner claims that he is having clean antecedent and is in custody since 20.09.2017.
Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-VII-cum-Special Judge, Excise, East Champaran at Motihari in connection with Motihari Town P.S. Case No. 629 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
