No. 3386 of 2009 was disposed of with a direction that in case vacancies exist for appointment in a Class-III post in S.U. College, Hilsa, action be taken for considering the case of the petitioner for appointment to the said post.
Respondent No. 3 has filed a detailed show-cause and has indicated that no Class-III post has been sanctioned in the College in question. The sanctioned posts are those of Office Assistant 4 posts, one post of Store Keeper and indicating that in the absence of there being no sanctioned post of Class-III in the S.U. College, Hilsa, no action can be taken for considering the case of the petitioner for promotion, the Nodal Officer of Magadh University, Bodh Gaya has
Patna High Court MJC No.2334 of 2012 dt.21-06-2017 2/2 filed a show-cause notice.
Keeping in view the aforesaid and the fact that the order passed in the Writ Petition was only to consider the case of the petitioner for grant of promotion, no case is made out for initiating action for contempt. Now, in the facts and circumstances of the case, in case the petitioner has any grievance with regard to the matter, he may initiate proceedings in accordance with law but in the light of the nature of order passed and the show-cause filed by the University, no case is made out for initiating action for contempt. The contempt application stands disposed of.
