ANJANA MISHRA ORAL ORDER 05-08-2015 Heard learned counsel for the petitioners and the learned counsel for the State.
The petitioners are apprehending their arrest in connection with Siwan SC/ST P.S. Case No.77 of 2014 for allegedly having committed the offences under Sections 341, 323, 504 and 506/34 of the Indian Penal Code and Section 3(i)(x)(xv) of the S.C./ST Act.
Learned counsel for the petitioners submits that the petitioners have been accused of using abusive language and assaulting the lady and also stating that she belongs to a lower caste and she should not enter into the temple. However, a perusal of the F.I.R. reveals that the said allegations have not been made in public view and there is no
Patna High Court Cr.Misc. No.30178 of 2015 (2) dt.05-08-2015 2/2 independent witness to support the case of the complainant. It has also been pointed out that there is no injury report on the record.
Considering the aforementioned submissions and also the fact that the petitioners have no criminal antecedents, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, in connection with Siwan SC/ST P.S. Case No.77 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
