JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 22-08-2017 The petitioner is aggrieved by notice, dated 01.08.2016, issued by the Inspector, Bihar State Madarsa Education Board, Patna (hereinafter referred to as the Board), making a communication to the effect that an enquiry has been assigned to him to examine the dispute between the two Managing Committees claiming to be the real Managing Committee of the Madarsa Gausia Noor Para, Natuapara Madarsa in the district of Kishanganj. There is another relief, which has been sought that is to accept the enquiry report, dated 23.09.2015, of the Regional Deputy Director Education, Purnea, which has already been submitted before the Board.
2. There is apparent dispute between the Managing
Patna High Court CWJC No.15443 of 2016 (6) dt.22-08-2017 2/2 Committees claiming to be the real Managing Committee of Madarsa in question.
3. The nature of relief, which has been sought for cannot be entertained in the present proceeding.
4. The petitioner shall, however, have the liberty to prefer appeal, if permissible, under Section 28 of the Bihar State Madarsa Education Board Act, 1981.
5. This application stands disposed of with the observation as above.
