The petitioner is in custody since 14.05.2017 in connection with Kamtaul P.S. Case No. 84 of 2017 for the offence registered under Sections 302, 201 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that save and except his own confessional statement made before the police, which has no evidentiary value, there is nothing against this petitioner. It is further submitted that only because the petitioner's mobile number was found to be in the vicinity from where the dead body of unknown person was recovered, the police presumed that the petitioner had an hand in the occurrence. It is further submitted that on the basis of such vague and indefinite charges, the petitioner has been put behind the bar.
