The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 324, 326, 307, 504 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that on instigation of Heera shukla firing was resorted to by co-accused Ram Ekbal Shukla, causing injury on the thigh of informant's nephew. Thereafter Heera Shukla caused firearm injury on the leg of informant's nephew. Subsequently, Sanjay Shukla and others also resorted to fire.
It is submitted by the learned counsel for the petitioner that medical report suggests only two injuries caused
Patna High Court Cr.Misc. No.29274 of 2015 (2) dt.27-07-2015 by Heera Shukla and Ram Ekbal Shukla. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the fact that specific accusation is against co-accused Heera Shukla and Ram Ekbal Shukla, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (T) P.S. Case No. 191 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
