JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-12-2017 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek regular bail in connection with Siswan P.S. Case No. 147 of 2017 instituted for the offences under Sections 272, 273 and 308 of the Indian Penal Code and Sections 30(A) and 38(1) of the Bihar Excise & Prohibition Act, 2016. The allegation is regarding recovery of 298.56 litre of illicit liquor from a poultry farm of the co-accused. The learned counsel for the petitioners submits that no recovery has been effected from the conscious possession of the petitioners. The petitioners are accused in one other case of same and similar nature in which they are already on bail and they are languishing in custody since 23.09.2017.

Patna High Court Cr.Misc. No.58778 of 2017 (2) dt.22-12-2017 2/2 Considering the nature of accusation and the period of custody already undergone, I direct the petitioners named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IInd, Siwan in connection with Siswan P.S. Case No. 147 of 2017.
