2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 7 of the Essential Commodities Act.

3. As per prosecution case, petitioner is alleged to have committed irregularities in the distribution of government subsidized food grains and indulged in black marketing. On the alleged date of raid, 53.43 quintal wheat and 55.11 quintal of rice were found short.

4. It is submitted by learned counsel appearing on behalf of the petitioner that the petitioner used to distribute the essential commodities as per scheduled quantity among the consumers and no consumer has made any complaint against the petitioner. On the alleged date of raid, the petitioner suddenly fell ill in the morning and thereafter went for treatment to the

Patna High Court CR. MISC. No.24176 of 2024(4) dt.08-07-2024 2/2 doctor and in the meantime, the Block Supply Officer, Sasraiya, arrived there for inspection and without proper verification, the report was made. Moreover, the P.D.S. license of the petitioner has already been cancelled.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the aforesaid facts and circumstances and the fact that P.D.S. license of the petitioner has already been cancelled, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. (West), Muzaffarpur, in connection with Saraiya P.S. Case No.516 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
