The petitioner seeks bail in Chakand P.S. Case No. 141 of 2018, instituted for the offence under Section(s) 302/34 of the Indian Penal Code.

Counsel for the petitioner submits that there is no allegation of specific overt act against the petitioner. His name has come during course of investigation because he is Sadhu of main accused Vijay Manjhi.

It is alleged in the written report that while informant was sleeping at his tea shop, his daughter namely, Sapna, informed him on Mobile Phone that Vijay Manjhi (uncle) and three unknown persons shot dead her mother and Md. Nazib Sah @ Md. Munna who were sleeping in the house. The

Patna High Court CR. MISC. No.19023 of 2019(4) dt.11-07-2019 2/2 informant came to the house and found both dead bodies in a room. He saw the firearm injury on the Kanpatti of the deceased. It is further alleged that brother-in-law (Sala) of the informant made protest then he also received injury on his left hand. Thereafter, Vijay Manjhi and three unknown persons fled away.

Petitioner is in custody since 1.11.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Chakand P.S. Case No. 141 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
