JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Keshariya P.S. Case No. 355 of 2018 registered for the offences punishable under Sections 341, 323, 384, 379, 34 of the Indian Penal Code and Section 27 of the Arms Act. Prosecution story as per FIR is that petitioner assaulted by butt of pistol on the ear and eye, causing injuries to the informant, he demanded Rs.1 lac and further taken away Rs.20,000/- and snatched gold chain from him. Submission of learned counsel for the petitioner is that the material collected during investigation disclosed that petitioner and informant are agents of two different buses and with respect to time of running of the buses the dispute arose and injuries are simple in nature and the allegations of taking

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XI, East Champaran, Motihari, in connection with Keshariya P.S. Case No. 355 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
