====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 18-07-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.
Heard learned counsel for the petitioner and the learned APP for the State.
Petitioner seeks regular bail in connection with Ghanshyampur P.S. Case No. 178 of 2017 registered for the offences under Sections 147, 148, 149, 423, 341, 302, 34 of the Indian Penal Code.
Allegedly, this petitioner and co-accused persons equipped with lathi, danda and brick came at the informant's house and thereafter started assaulting the informant's brother by the said means who died consequently.
The main submissions advanced by learned counsel for
Patna High Court CR. MISC. No.19141 of 2022(2) dt.18-07-2022 2/2 the petitioner are that the petitioner has been languishing in jail since 25th February, 2021 having clean antecedent and against him there is no specific allegation and co-accused persons have been granted the privilege of bail vide orders passed in Cr. Misc. No. 27045 of 2018, Cr. Misc. No. 86957 of 2019 and Cr. Misc. No. 66060 of 2021 and petitioner's case is under trial. Learned APP appearing for the State has opposed the bail prayer.
Having considered the above submissions and mainly the fact that other co-accused persons carrying similar nature of allegation like the petitioners have been considered for regular bail vide orders passed by different benches of this Court in above mentioned criminal miscellaneous cases, in my view a lenient approach can be taken in respect of petitioner's prayer let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in Connection with Ghanshyampur P.S. Case No. 178 of 2017.
