JUSTICE BIBEK CHAUDHURI ORAL ORDER 05-07-2024 The petitioner has invoked the Constitutional Writ Jurisdiction of this Court praying for compassionate appointment. The father of the petitioner died in harness on 16th April, 2015. The wife of the deceased employee first filed an application for compassionate employment on 22nd June, 2015. However, the said application was not considered by the respondent authority. Thereafter, the petitioner being the son has filed an application in prescribed format on 16th December, 2017. The said application has not been disposed of.

2. The petitioner's application was forwarded to the Joint Secretary, Panchayati Raj Department, Bihar, Patna by the

Patna High Court CWJC No.5925 of 2024(2) dt.05-07-2024 2/2 Deputy Development Commissioner-cum-Chief Executive Officer, Zila Parishad, Katihar for giving approval for compassionate appointment. Till date, the petitioner has not been appointed on compassionate ground. The petitioner submitted a fresh representation on 24th July, 2023 and on 24th November, 2023. However, his representations were not considered.

3. Learned Advocate on behalf of the State submits that the respondent nos. 4 and 5 are the competent authority to appoint the petitioner on compassionate ground.

4. In view of such submission, the representations filed by the petitioner on 24th July, 2023 and on 24th November, 2023 be forwarded to the respondent nos. 4 and 5 for approval of compassionate appointment of the petitioner within 60 days from the date of this order.

5. The instant writ petition is accordingly disposed of.

6. The petitioner is at liberty to act on the server copy of the order.
