This is an application for bail in connection with Kinjer P.S.Case No. 43 of 2017 registered for the offences punishable under Section 392 of the Indian Penal Code.

Petitioners are not named in the FIR and later on their names transpire in confessional statement of co-accused. Submission of learned counsel for the petitioners is that except confessional statement there is nothing against them and no recovery has been made from their possession and they are in custody for four months. Further submission is that though they are accused in two other cases but they are on bail in those cases. Heard learned APP also.

Having heard both sides and in view of facts and

Patna High Court Cr.Misc. No.53093 of 2017 (2) dt.15-11-2017 2/2 circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sri Sanjeev Kumar, Additional Chief Judicial Magistrate-III, Arwal, in connection with Kinjer P.S.Case No. 43 of 2017, subject to the following conditions : (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioners shall co-operate in trial and appear on each and every date in court, failing which their bail bonds shall be cancelled.
