The petitioner seeks bail in connection with Sultanganj P.S. Case No. 164 of 2017 dated 28.07.2017 instituted for the offence under Section 392 of the Indian Penal Code. The informant was waylaid and was divested of his belongings including mobile phone. From the mobile repairing shop of the petitioner, the looted mobile was recovered. The petitioner is said to have used such mobile for making calls to different persons.
Learned counsel for the petitioner has submitted that the aforesaid mobile was deposited in his shop for repairing and the petitioner had no idea that it was a looted property. The petitioner does not have any criminal antecedent
Patna High Court Cr.Misc. No.51255 of 2017 (3) dt.07-12-2017 and is in custody since 23.08.2017.
In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-5, Patna City, Patna in connection with Sultanganj P.S.
