The petitioner seeks regular bail in connection with Sikroul P.S. Case No. 22 of 2018 for the offences punishable under Sections 341, 323, 34 + 302 of the Indian Penal Code. The allegation is regarding the accused person including the petitioner having assaulted the informant of this case resulting in his death subsequently.

The learned counsel for the petitioner submits that as far as the petitioner is concerned, he is old person and the allegation as against him is only slapping the deceased whereas the allegation on the co-accused namely Vinod Singh is assaulting the deceased by Lathi (Bamboo stick) and the cause of death mentioned in the postmortem report is injury sustained by the

No.33984 of 2018 (3) dt.23-07-2018 2/2 deceased by hard and blunt substance, hence the death of the informant cannot be attributed to any assault or overt act on the part of the petitioner. The petitioner is having a clean antecedent and is languishing in custody since 13.04.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Buxar in connection with Sikroul P.S. Case No. 22 of 2018.
