The petitioner seeks bail in G.R.P. (Patna Jn.) P.S. Case No. 343 of 2015 registered under Sections 186, 201, 353, 506 and 120B of the Indian Penal Code, Section 66 (A) (a) (b) (c) of Information Technology Act, 2000, Section 150(E) of Railway Act, 1989 and Section 3(2e) of Public Property Prevention to Damage Act, 1984.
A hoax SMS is said to have been sent on the mobile phone of Inspector General of Police, Railway to blow the Patna Sahib Railway Station.
It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence.
Patna High Court Cr.Misc. No.54240 of 2017 (2) dt.13-12-2017 2/2 He had not sent such SMS. As a matter of fact, the mobile phone from which the SMS was sent is hailing to co-accused Vijay Kumar and there is nothing in the record indicating the complicity of the petitioner in the occurrence barring the confessional statement of the co-accused Poonam Devi who happens to be his wife. Said Vijay Kumar and Poonam Devi have been enlarged on bail by this Court in Cr. Misc. No. 22066 of 2016 dated 04.07.2016 and 39764 of 2016 dated 19.09.2016 respectively. The petitioner has been languishing in custody since 30.03.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-X, Patna in connection with G.R.P. (Patna Jn.) P.S. Case No. 343 of 2015.
