The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 8(c), 21(b) of the N.D.P.S. Act.

As per FIR, prosecution case relates to recovery of 200 gram Heroine from a vehicle bearing Registration no. BR03PA-0246 and the petitioner is alleged to be apprehended on spot.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The petitioner has no concern with the alleged recovery of Heroine like narcotic substance and the same is alleged to be 200 gram which does

So far as seized vehicle is concerned, the same does not belong to the petitioner and was being driven by co-accused at the time of occurrence. Nothing any incriminating article has been recovered from his conscious possession. The petitioner has got no criminal antecedent is languishing in judicial custody since 4.10.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Shahpur P.S. Case No. 353 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-XIII, Bhojpur at Ara. (Sunil Kumar Panwar, J) Manish/- U T
