JUSTICE SUDHIR SINGH ORAL ORDER 30-07-2015 The petitioner is apprehending his arrest in connection with Complaint Case No. 225C of 2014 for the offence under Sections 406,420 of the Indian Penal Code. Heard learned counsel for the petitioner and the State.
The prosecution story, in brief, is that the petitioner along with his mother, who are own brother and mother of the complainant misappropriated complainant's gold ornaments worth Rs. 01,45,000/- on the pretest of taking loan, which was being returned within six months.
It is submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The matter relates to civil dispute. Petitioner and complainant are the own brother and sister. The mother of the complainant has also been made accused in the present case.
Patna High Court Cr.Misc. No.30637 of 2015 (2) dt.30-07-2015 On behalf of the State, it has been submitted that the petitioner is named in the First Information Report. Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Barh, Patna in connection with Complaint Case No. 225C of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
