JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-07-2018 Heard learned senior counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Majorganj P.S. Case No. 412 of 2017 registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code. The allegation is regarding the deceased lady having been killed by the petitioner herein who happens to be the husband.

The learned senior counsel has submitted that the marriage has been solemnized 17 years ago and the death of the wife of the petitioner has taken place on account of electrocution which is substantiated from the statement of the independent witnesses recorded during the course of the investigation. The

No.34178 of 2018 (3) dt.23-07-2018 2/2 learned senior counsel has also referred to paragraph no. 51 of the case diary wherein the son of the petitioner has stated that his mother had died on account of electrocution. The petitioner is stated to be languishing in custody since 21.04.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Majorganj P.S. Case No. 412 of 2017.
