JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-05-2019 This is an application for grant of anticipatory bail in connection with Hisua P.S. Case No.138 of 2018 disclosing offences under Sections 147, 148, 149, 323, 379, 307, 354 (B), 504 of the IPC.
Prosecution story is that petitioner no.1 has assaulted by Gandas blow on the head of the informant, causing injury and petitioner no.2 tried to outrage the modesty of daughter -inlaw of the informant. Submission of the learned counsel for the petitioner is that there is a dispute between the parties and injuries are simple in nature and the offence of outrage modesty is not made out against the petitioner no.2. Further submission is that no offence

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Hisua P.S.
