JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-08-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 461/34 and other ancillary sections of the Indian Penal Code.

Prosecution case is that petitioner is alleged to have broken the lock of the flat of the informant and started doing business from there.

Learned counsel for the petitioner submits that the allegation against the petitioner is vague in nature and no specific allegation has been made against the petitioner. Flat in question has been owned and possessed by one Kartik Sahu and informant never came in possession of the said flat and the petitioner was doing business from the said flat on the instruction of Kartik Sahu. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Patna in Kotwali Police Station Case No. 49 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
