JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 20(b),(II),(B)/ 29 of the N.D.P.S. Act.
As per the prosecution case, police recovered illegal ganja from the house of the apprehended person, namely Jeetan Singh, who disclosed the name of this petitioner. Learned counsel for the petitioner submits that the petitioner is innocent and his name has surfaced only on the basis of confessional statement of the accused person, namely Jeetan Singh, who was arrested by the police. He further submits that nothing has been recovered from the possession of the petitioner. Petitioner claims clean antecedent.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Bhojpur at Ara in connection with Udwantnagar (Gajrajganj) P.S. case no. 52 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
